Welcome to Zeleva Health (“Zeleva”, “we”, “us”, or “our”). We operate this website and online store, along with related content, features, tools, and services (collectively, the “Services”). Our store is hosted and powered by Shopify.
By accessing or using our Services, you agree to these Terms of Service (the “Terms”) and to our Privacy Policy. If you do not agree, please do not use the Services. Please read these Terms carefully before placing an order.
1. Eligibility, Accounts & Security
You must be at least 21 years old (or the age of majority where you reside) to purchase from or use our Services.
If you allow a minor to use a device you own to access our Services, you are responsible for that use.
You may need to create an account and provide certain information (e.g., name, email, billing and shipping address). You agree that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We strive to display our products accurately, but colors and appearance may vary by device.

3. Orders, Acceptance & Cancellations
By placing an order, you make an offer to purchase. Orders are accepted only when we send written confirmation or ship your items.
We may cancel or refuse any order for any reason, including unavailability, suspected fraud, compliance concerns, or errors. If payment was collected, we’ll refund the cancelled portion.
Your purchases are subject to our Refund/Return Policy (linked in the site footer).
Resale or redistribution of our products without written consent is prohibited.
4. Pricing, Taxes & Billing
Prices and promotions may change at any time. The price shown at checkout applies.
Unless otherwise stated, prices exclude taxes, shipping, and customs duties.
By providing a payment method, you represent that you’re authorized to use it and authorize us (and our payment processor) to charge the full order amount.
Subscriptions & Auto-Renewals:
If you enroll in a subscription, you authorize recurring charges until cancellation. You can cancel anytime before renewal through your account or by contacting us.
5. Shipping, Risk of Loss & Customs
Delivery times are estimates only. We are not responsible for carrier delays, customs holds, or events beyond our control.
Title and risk of loss transfer when the shipment is handed to the carrier (unless mandatory local laws require otherwise).
International Orders:
You are responsible for ensuring import legality and paying any duties/taxes.
If customs detains, refuses, or seizes a shipment, we may refund the product price (minus shipping) or refuse reshipment at our discretion.
6. User Content, Reviews & Feedback
If you post a review or submit content (“Feedback”), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, and display it for marketing and operations.
You represent that you own the rights to your content and that it is truthful, lawful, and not misleading.
If you received compensation or an incentive, you must disclose that connection.
We may remove or moderate content that violates laws or these Terms.

We are not responsible for third-party content, products, or practices. Always review their terms and privacy policies before use.
9. Relationship with Shopify
Our Services are hosted on Shopify, which powers our store infrastructure.
However, all sales are made directly by Zeleva Health.
By using our Services, you agree that Shopify is not responsible for your purchases or any resulting damages, and you release Shopify from related claims.
10. Compliance, Export & Sanctions
You agree to use the Services lawfully and comply with all applicable trade, export, and sanctions laws.
You may not purchase, ship, or use products on behalf of persons or entities in sanctioned or restricted jurisdictions.
You also agree not to misrepresent identity, intended use, or destination to bypass eligibility or legal restrictions.
11. Errors & Availability
Occasionally, there may be typographical or pricing errors.
We reserve the right to correct, update, or cancel orders based on inaccurate information, even after submission, as permitted by law.
12. Disclaimer of Warranties
Except where required by law or expressly stated by Zeleva, our Services and products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
We do not guarantee uninterrupted or error-free operation. Some jurisdictions may not allow these exclusions.
13. Limitation of Liability
To the fullest extent permitted by law, Zeleva Health and its affiliates, officers, employees, agents, service providers, or licensors (and Shopify and its affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or revenue.
Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
Certain jurisdictions may limit these exclusions.

You agree to indemnify and hold harmless Zeleva Health, Shopify, and their affiliates, officers, employees, agents, and service providers from any claims, losses, or expenses (including reasonable legal fees) arising from:
(a) your breach of these Terms,

(c) misuse of our Services or products (including RUO items).
15. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, wars, labor strikes, cyberattacks, or supply chain disruptions.

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason.
You remain responsible for all charges incurred prior to termination.
Sections that by nature should survive (e.g., IP, Feedback, Disclaimers, Limitation, Indemnity, and Governing Law) shall survive.
17. Governing Law & Venue
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein.
You agree to the exclusive jurisdiction of the courts of Ontario, Canada, except where local consumer rights require otherwise.

We may update these Terms periodically. The “Last Updated” date will always reflect the latest version.
Material changes will be clearly indicated or notified as required by law.
Continued use of the Services means acceptance of the revised Terms.
Headings are for convenience only. If any provision is found unenforceable, it will be modified to the minimum extent necessary; the remainder remains valid.
You may not assign your rights or obligations without our written consent; we may assign freely.
